BBG Debarment/Suspension proceedings for FAR contractors

This scheme sets out the BBG's procedures for suspending or debarring contractors under the Federal Acquisition Regulation (FAR) system, which establishes uniform policies for the acquisition of supplies and services by executive agencies. Those regulations require agencies to promulgate procedures governing how they may prosecute cases of debarment and suspension. See FAR 9.406-3(b); 9.407-3(b).

Comments/Notes on Adjudication Structure: 
BBG's regulations designate the Director of the Office of Contracts as the "Board Procurement Executive." He/she is delegated the "full delegable authority" from the Board with respect to acquisition of goods and services by contract and other matters covered by the Federal Acquisition Regulations. -48 CFR 1909.406-3(b) states that the Board Procurement Executive shall preside and make all findings if contractors desire to present information and arguments in writing. If they desire to make oral presentations, however, they appear before a three-person fact-finding board composed of one member each from the Office of General Counsel and Congressional Liaison, the Bureau of Management, and the Office of Contracts. This panel in turn submits its factual findings to the Board Procurement Executive. The fact-finding board is designated as Hearing Officer 2.
