Brief Description of Case Type: 
This case type involves hearings over whether chemical pesticide residue found in food violates the EPA's regulations, and if it does whether the EPA should reconsider the tolerance level of residue of the chemical allowed in the food. Any person adversely affected by an EPA order on this issue can request a hearing. See 40 CFR 178.20. "(b) A request for an evidentiary hearing will be granted if the Administrator determines that the material submitted shows the following: (1) There is a genuine and substantial issue of fact for resolution at a hearing. An evidentiary hearing will not be granted on issues of policy or law.
