EPA Panel and Pesticide Appeals

This scheme provides for a hearing before an Administrative Law Judge with an appeal available to the Administrator of the EPA. In cases to review approval or disapproval of a Primary Nonferrous Smelter Order (NSO) under the Clean Air Act., there is an advisory body known as an "EPA Panel" sit in on a hearing and participate in the hearing through questioning and submission of evidence.

Comments/Notes on Adjudication Structure: 
An EPA Panel sits in on the hearing and may participate in cross-examination for certain case types. "In general, the membership of the panel shall consist of EPA employees having special expertise in areas related to the issues to be addressed at the hearing, including economists and engineers. For this reason, the membership of the panel may change as different issues are presented for discussion." See 40 CFR 57.807.
