This scheme primarily governs hearings conducted pursuant to the Program Fraud Civil Remedies Act (31 U.S.C. 3801 et seq.), which admonishes agencies to develop procedures for imposing civil penalties against persons who make, submit, or present, or cause to be made, submitted, or presented, false or fraudulent claims for payment. The scheme also governs enforcement proceedings against those who use appropriated agency funds to engage in prohibited lobbying activities, because the regulations governing such cases default to the penalty procedures used in program fraud cases.
