Scheme Nickname: 
National Oceanic and Atmospheric Administration Formal Scheme

This scheme allows for hearings on several different sanctions or penalties entities may receive pursuant to the authority of the National Oceanic and Atmospheric Administration (NOAA).

There is a right to appeal to the Administrator of NOAA.

NOTE: This is a formal adjudication scheme and uses administrative law judges (ALJs). However, the Department of Commerce and its constituent agencies do not employ ALJs and use ALJs from other agencies to conduct DOC hearings. While NOAA formerly used Coast Guard ALJs (like the rest of the Department) since 2011, ALJs from the Environmental Protection Agency have performed hearings due to their perceived expertise in matters of the environment.

Comments/Notes on Adjudication Structure: 
NOTE: The Office of General Counsel oversees this scheme even though the actual ALJs used to conduct the hearings are from the EPA Office of Administrative Law Judges. Previously NOAA used Coast Guard ALJs but in 2011 changed to the EPA. All information pertaining to the cases are contained on the Office of General Counsel's webpage, and the EPA's involvement is solely in supplying ALJs.
