Debarment proceedings commence under an Airports Authority Debarment Judge (ADJ). Appeals of ADJ determinations are available to the MWAA CEO. See MWAA Contracting Manual, 4th ed. §§ 9.5.3 - 9.5.4 (Apr. 2013).
Comments/Notes on Adjudication Structure:
The causes for debarment listed in § 9.5.1(6)-(9) are allocated to the Authority Debarment Judge (ADJ).
Suspensions are another route through which to enter debarment adjudication proceedings. Suspensions normally remain in effect until debarment proceedings are complete. If a contractor files a timely opposition to the suspension, the EVP considers that information and decides, in his/her discretion, whether to revoke the suspension or to continue the suspension pending completion of debarment proceedings. The EVP provides written notice of his/her determination regarding the suspension. See § 9.6.1.
