Manufactured Home Presentation of Views
This scheme provides for either formal (adversary) or informal (non-adversary) presentations of views (and evidence) by interested parties to a HUD presiding official on specified matters under the National Manufactured Housing Construction and Safety Standards Act of 1974 (NMHCSSA). (The NMHCSSA requires the Secretary to permit interested parties to present their views on specified matters before taking action.)
Comments/Notes on Adjudication Structure:
Formal Presentation of Views: The presiding officer's decision is not subject to appeal, but can be reversed or modified by the Secretary. See 24 CFR 3282.152(g).
Informal Presentation of Views: The presiding officer makes findings and sends them to the Secretary who issues the actual decision. See 24 CFR 3283.152(f).
