This scheme covers informal hearings performed by Administrative Judges in the Office of Appeals. All cases involve some form of administrative sanction against a HUD employee, grantee, or contractor. Though technically "informal" in the APA sense, the procedural formality observed in most types of cases is similar to procedures used in HUD's APA hearings. Compare 24 pt. 26 subparts A (applicable to Office of Appeals) vs. B (applicable to APA hearings). Some, but not all, cases permit appeal to the Secretary.

There is no appeal to the Secretary allowed for nonprocurement debarment and suspension proceedings governed by 2 CFR Part 2424. See 24 CFR 26.26(a).

Overlapping schemes relates to nonprocurement debarments, suspensions, and limited denials of participation. Suspending/debarring officials in HUD's Departmental Enforcement Center (HUDDECOO0009) conduct written hearings on nonprocurement matters, unless there are disputed facts. If facts disputed, Administrative Judges (or, occasionally, ALJs) housed in the Office of Hearings and Appeals conduct fact-finding hearings and submit written recommendations to the DEC deciding official.
