This scheme primarily governs hearings conducted pursuant to the Program Fraud Civil Remedies Act (31 U.S.C. 3801 et seq.), which instructs agencies to develop procedures for imposing civil penalties against persons who make, submit, or present, or cause to be made, submitted, or presented, false or fraudulent claims for payment. -The name of the hearing office is not entirely clear from the governing regulations (41 CFR Part 105-70). -41 CFR 105-70.039 delegates appellate authority to the "Authority Head," which is in turn defined as the Administrator or Deputy Administrator of General Services (i.e., the agency head or his deputy). See 41 CFR 105-70.002(c).
