Scheme Nickname:
Federal Transit Administration school bus violation proceedings
This scheme captures the proceedings conducted under 49 CFR Part 605, Subpart D. Much like Part 604 protecting private charter bus operators, Part 605 aims to protect private school bus operators by requiring applicants seeking FTA funding for public mass transit facilities and equipment to agree that they will not exclusively engage in school bus operations in competition with private school bus operators. See 49 CFR 605.1(b). Cases alleging violation of these agreements are adjudicated under the procedures set out in 49 CFR Part 605, Subpart D. As this subpart consists of only a handful of short regulatory sections, many of the fields in this form are left blank.
Comments/Notes on Adjudication Structure:
-The regulations delegate adjudicatory power over these cases to the FTA Administrator (i.e., the agency head). See 49 CFR 605.30 - 605.34.
