September 11th Victim Compensation Fund Appeals

Informal proceeding in which claimants of the September 11th Victim Compensation Fund appeal either the determination that they are ineligible for benefits or in which claim the amount of their benefits was erroneously calculated. Eligible claimants include people that experienced personal injury due to their presence at a 9/11 crash site as well as the Personal Representatives of those that died at a crash site. After claimants file, Claim Evaluators conduct an initial review of the forms for completeness and notify claimants of any deficiencies. Claim Evaluators then determine eligibility and the amount of the presumed award and notify the claimant or those determinations as well as the claimant's right to request a hearing, within 30 days, before the Special Master or her designee. 28 CFR Subpart C.

Comments/Notes on Adjudication Structure: 
Claimants reach the hearing level by appealing either their ineligibility determinations or by claiming the amount of their award was erroneously calculated. Claimants also have the option to amend their claims in light of new information or changed circumstances described in more detail at 28 CFR 104.22(e).
