Patent Compensation Board

The Patent Compensation Board has the authority to determine royalty fees or resolve issues involving the grant of awards (e.g., whether a patent is affected with the public interest, whether a patent license should be granted). The Board consists of three members, appointed by the Secretary of Energy or the Under Secretary for Nuclear Security. The Board's decision may be based either on the paper record or a hearing. In either instance, the decision of the Board is final.
