Termination of grants
Formal proceedings in which an AmeriCorps*VISTA or National Senior Center Corps grantee or contractor may challenge CNCS's notice of intent to to terminate funding of any existing grant or contract based on serious failure to comply with program requirements. CNCS action may be based on either substantial failure to comply with Corporation policy or program objectives, or failure to comply with grant terms based on wrongdoing of recipient. By regulation, recipients who do not otherwise have counsel (such as in-house counsel) may designate at attorney to represent the organization in the termination proceedings, with the cost paid by transferring sufficient grant monies to pay for attorney's fees, travel, and per diem expenses. (However, attorney's fees are capped at $100 per day without prior CNCS approval.) CNCS will also, upon request, pay travel and per diem expenses for up to 2 representatives of the grantee/contractor to the hearing location. Hearings are held in the area where the grantee/contractor are located, a CNCS service center or state office, or other appropriate location. (45 CFR 1206.1-9)
