Comments/Notes on Adjudication Structure: 

The Trade Adjustment Assistance Program for Workers (TAA) is administered by the Office of Trade Adjustment Assistance within the Department of Labor’s Employment and Training Administration (ETA). The Trade Act of 1974 requires the Secretary of Labor to offer petitioners for certification of group eligibility for TAA, as well as other persons with a substantial interest in the certification determination, the opportunity to submit a request for a hearing to be present, to produce evidence, and to be heard.

However, although the longstanding TAA regulations codified at 29 CFR part 90 describe the hearing process, no hearings have been held in at least the last 30 years of operation of the TAA program. Therefore, the survey does not apply to TAA.
