Brief Description of Case Type:
Informal proceeding in which the Commission decides whether a grant for parole should be rescinded due to the prisoner's misconduct. Rescission proceedings are generally prompted by a finding that the prisoner violated institutional rules, in a hearing conducted by a Discipline Hearing Officer of the Bureau of Prisons. The Regional Commissioner will be advised of such a finding and may reopen the case and delay parole without a hearing or may order a rescission hearing. Rescission is distinguishable from revocation in that revocation occurs after a prisoner has been released on parole, while rescission occurs after the decision to grant parole has been made but before the prisoner's physical release from the correctional facility. The two actions also differ in procedure, and revocation follows a separate adjudication scheme.
