Proceedings providing formal public hearing on marketing orders proposed by any organization certified under the Potato Promotion Act, an interested person affected by the Potato Promotion Act, or the Secretary. The Potato Promotion Act authorizes establishment of orderly procedures for development, financing (through assessments) of coordinated program of promotion, education and related research. Additionally, affected parties may also petition for modification/exemption from existing orders based on allegations that an order "is not in accordance with law." Lastly, section 2621 of the Potato Promotion Act authorizes the Secretary to impose civil penalties against violators or to issue cease and desist order after opportunity for hearing.
