Brief Description of Case Type: 
The AMAA authorizes the Secretary to establish marketing conditions for specified agricultural commodities by entering into marketing agreements between USDA and handlers and producers regarding price, grades, and quality, and/or by issuing marketing orders. Proceedings to establish (or amend) a marketing agreement or order may be initiated by the Secretary or affected parties. Additionally, affected parties may also petitions for modification/exemption from marketing orders based on allegations that an order "is not in accordance with law." Lastly, section 608(c)(14) of the AMAA also provides for assessment of civil penalty for any violators.
