These cases are appeals to OHA related to a business entity's eligibility for participation in the Section 8(a) Business Development (BD) Program. Sections 8(a) and 7(j) of the Small Business Act authorize a Minority Small Business and Capital Ownership Development program (designated as the 8(a) Business Development or “8(a) BD” program) to assist eligible small disadvantaged business concerns compete in the American economy through business development, contracting assistance and financial support. See 13 CFR 124.1; 13 CFR 124.404. Cases may involve denials of 8(a) BD program admission based on negative findings as to social or economic disadvantage, early graduation from the program at the behest of the SBA, termination or suspension of businesses' program participation, or denials of requests for waiver of the program requirements.
