Brief Description of Case Type: 
Approval or rejection of state plans for development and enforcement of state occupational safety and health standards. After publication of notice of a proposed state plan in the Federal Register and receipt of public comments, arguments and data, the Assistant Secretary for Occupational Safety and Health may give notice of an informal or formal hearing (29 CFR § 1902.11(e)). A formal hearing is conducted under 5 U.S.C. §§ 556 and 557, and the presiding officer certifies the record of the hearing to the Assistant Secretary, who will issue a tentative decision. After ruling on any exceptions that may be filed, the Assistant Secretary will issue a final decision to approve or reject the state plan (29 CFR § 1902.22).
