[5] Enforcing orders: Proceedings to enforce agency orders (e.g. cease-and-desist orders, exclusion orders, consent orders, etc.), where the agency must determine whether a party violated an existing order. See 19 C.F.R. § 210.75. These proceedings are authorized under 19 U.S.C. § 1337(b) as investigations on whether there is a violation of that section - and the proceedings are conducted in the same manner as original investigations, in accordance with 19 C.F.R. part 210 and the formal APA adjudication procedures. 19 C.F.R. § 210.75(b). Among Commission relief options are modifications of existing orders, civil monetary penalties, revocation of existing consent orders, and goods seizure orders. 19 C.F.R. § 210.75(b)(3)-(4).
