Brief Description of Case Type: 
A mortgagee can request review of an administrative action against a lender or mortgagee by the Mortgagee Review Board for probation, suspension, or withdrawal of a mortgage. May also include review of complaint issued by HUD (after approval by majority of Mortgage Review Board) counsel seeking civil monetary penalties for knowing violations. Maximum penalty for most violations is $8,500 per violation up to limit of $1,525,000. Statutory authorities for civil penalties, in addition to National Housing Act, include: Real Estate Settlement Procedures Act; (12 USC 2601 et seq.); Equal Credit Opportunity Act (15 USC 1691 et seq.); and Fair Housing Act (42 USC 3601 et seq.).
