Proceedings in which a dealer or third-party originator may challenge a HUD complaint for civil penalties based on a material and knowing violation of the NHA, including: falsifying statements on HUD credit application; falsely certifying that lender that loan proceeds will be used for eligible improvements; making false representation about credit-worthiness of borrower of eligibility of improvements. Maximum penalty is $8,500 per violation up to a maximum of $1,525,00 during any one-year period.
