Temporary Reinstatement Proceedings: Proceedings relating to a miner’s allegation that he/she has suffered adverse employment action as a result of engaging in an activity protected under the Mine Act, such as making a safety complaint. If the Department of Labor's Mine Safety and Health Administration (DOL/MSHA) finds that a discrimination complaint was not frivolously brought, DOL/MSHA may file an application for temporary reinstatement of the miner to his/her former position.
