Brief Description of Case Type: 
Discrimination Proceedings: Proceedings relating to a miner’s allegation that he/she has suffered adverse employment action as a result of engaging in an activity protected under the Mine Act, such as making a safety complaint. Discrimination complaints may be filed either by the Department of Labor's Mine Safety and Health Administration (DOL/MSHA), following an investigation of a miner's discrimination allegation, or if the Secretary declines to file a complaint, by the miner. Complaints filed by the Secretary shall seek civil penalties for the alleged violation of section 105(c) of the Act, 30 U.S.C. 815(c).
