Contest Proceedings: Proceedings that provide a mine operator with the opportunity to contest a citation or order issued under the Federal Mine Safety and Health Act of 1977 (Mine Act) by the Department of Labor's Mine Safety and Health Administration (DOL/MSHA). An operator may contest a citation, an order, or the reasonableness of the length of time fixed for abatement in a citation or modification thereof issued under section 104 of the act. Additionally, a miner or miner representative may contest the issuance, modification or termination of any order and the reasonableness of the length of time fixed for abatement in a citation or modification
