Brief Description of Case Type: 
Enforcement proceedings against manufacturers, dealers, sellers, importers, and other persons for violation of rules or prohibited conduct under program to control emissions from new and in-use nonroad compression-ignition engines under the Clean Air Act. Non-monetary penalties may include: suspension, revocation, or voiding of manufacturers' certificates of conformity for engines that fail selective enforcement audits; revocation or suspension of certificate of conformity for an independent commercial importer (ICI); ineligibility of ICI to apply for new certificates; or ineligibility of ICI to perform modification or testing of nonroad engines. Civil penalties range from $2,750 - $32,500 per violation or day, depending on the type of violation. Maximum penalty may not exceed $270,000 unless Administrator and Attorney General jointly determine that larger penalty is appropriate.
