Brief Description of Case Type: 
Chapter 535 of Title 46 of the U.S. Code authorizes the creation of capital construction funds in the nature of agreements between citizens and the government. The purpose of such agreements is to provide replacement vessels, additional vessels, or reconstructed vessels for operation in the U.S. foreign, Great Lakes, noncontiguous domestic, or short sea transportation trade. See 46 U.S.C. 53503; see also 46 CFR 390.1. Parties deemed in violation of these agreements may appeal that determination to the Maritime Administrator and request a "hearing on the record;" if granted, the hearing must proceed pursuant to the rules of practice in 46 CFR Part 201. See 46 CFR 390.13(e).
