Brief Description of Case Type:
These cases arise out of disputes over whether a vessel has complied with the conditions prerequisite to receiving "operating-differential" subsidies from the Maritime Administration. Such subsidies allow vessel operators to receive compensation for certain maintenance and repair (M&R) expenses. Operators whose vessels have undergone foreign non-emergency repairs may be subject to a civil penalty in an amount equal to the total cost of such repairs, to be deducted from the operator's otherwise-accrued subsidy. Appeals are heard by the Maritime Subsidy Board.
