Unlawful Employment of Aliens Formal proceedings in which the Department of Homeland Security seeks civil penalties against employers who: 1) fail to prepare and maintain the required employment eligibility verification forms documenting newly-hired employees? and re-verifying current and returning employees' identities and legal authorization to work in the United States; 2) knowingly hire, recruit, refer for a fee, or knowingly continue to employ aliens who do not have legal authorization to work in the United States; or 3) demand money or indemnity bonds from their employees (as a condition for employment) in order to pay for potential employer fines for violation of these provisions. Remedies include an order to cease and desist from the violating behavior, civil monetary penalties, and an order to comply with the employment verification requirements of the Immigration and Nationality Act.
