Bond Redetermination Proceedings: Generally, aliens detained by DHS may be released from custody upon the payment of bond, usually set by DHS. An alien may request a bond hearing in order to redetermine the amount of bond set by DHS, based on his or her materially changed circumstances. Pursuant to 8 CFR 1003.19(h)(2)(i), IJs do not have jurisdiction to conduct bond hearings for 1) aliens in exclusion proceedings, 2) arriving aliens in removal proceedings, 3) aliens ineligible for release on security or related grounds, and 4) aliens ineligible for release on certain criminal grounds. IJs also lose jurisdiction when bond becomes moot (e.g. alien departs from U.S.). Bond redetermination decisions may be appealed to the BIA.
