Rescission Proceedings: Informal proceedings initiated by DHS in which the Immigration Judge determines whether an alien's adjusted status as a lawful permanent resident should be rescinded because the alien was not entitled to become a lawful permanent resident. Decisions may be delivered orally or in writing and shall direct either that the proceeding be terminated or that the adjustment of status be rescinded. 8 CFR 1246.6. Rescission decisions are appealable to the BIA.
