Proceedings in which a party may seek administrative review of adverse initial determinations by the ONHIR land Manager finding a violation of ARPA and imposing civil penalties. For persons with no prior ARPA violations, the maximum penalty is the full cost of restoration and repair of the archaeological resources damaged, plus the commercial value of resources destroyed. For persons who have violated ARPA previously, the maximum penalty is double the cost of restoration and repair and commercial value of resources destroyed.
