Brief Description of Case Type: 
This case type provides for review of the Administrator's withdrawal of approval of a state program under the Clean Water Act. These programs are National Pollutant Discharge Elimination Systems (NPDES). An NPDES is a program where "the state must prohibit all point source discharges of pollutants, all discharges into aquaculture projects, and all disposal of sewage sludge which results in any pollutant from such sludge entering into any waters of the United States within the State's jurisdiction except as authorized by a permit in effect under the State program or under [the Clean Water Act]. See 40 CFR 123.1(g)(1). The Administrator must commence a proceeding to decide whether to withdraw approval of a state program. However, he may do so on the petition of any interested person alleging failure of a State to comply with the requirements of 123.63 (incorporating sewer sludge programs found in 40 CFR Part 501 as well).
