For salary offset, a presiding official, who is "not under the supervision or control" of USAID, is selected by the Deputy CFO and conducts the hearing (either oral or "paper" hearing). Many agencies elect to use Administrative Law Judges for salary offset hearings. USAID does not employ any ALJs, so such adjudicators would need to be "borrowed" (via reimbursable agreement) from another agency. For collection of debts through administrative offset, USAID regulations provide that the CFO conducts an internal (agency) review and issues the final decision. (22 CFR Part 213)
