This scheme implements the Program Fraud Civil Remedies Act, and provides a defendant the opportunity to contest an administrative complaint by OPM for civil penalties (up to $5,000) or other monetary assessment based on submission of false or fictitious claims to OPM for payment, services, or benefits. The OPM reviewing official may issue a complaint only upon review and approval by the Department of Justice. (5 CFR Part 185)
