This informal adjudication scheme governs the review of adverse decisions by NRC concerning eligibility of agency employees, job applicants, or NRC contractors for access to restricted data under the Atomic Energy Act of 1954 (AEA) or national security information (Part 10) or special nuclear material (Part 11).
Comments/Notes on Adjudication Structure:
Administrative appeals (to the Commission) are only permitted in civil penalty actions under the PFCRA and findings of civil rights violations by program participants receiving, or applicants seeking, NRC funding; there is no appeals of adverse NRC decisions in debt collection actions.
