This scheme covers formal proceedings to suspend, terminate, or deny NEA funding to program participants or applicants based on a finding of noncompliance with requirements under the Age Discrimination Act of 1975 (42 USC 6101 et seq.), which prohibits recipients of federal financial assistance from discriminating on the basis of age in the operation of their programs or activities. Allegations or findings of noncompliance with the Age Discrimination Act may result from NEA compliance reviews or investigation of complaints received by NEA from any person or class of persons. (45 CFR Part 1156).

For matters related to nondiscrimination in federally assisted programs arising under the Age Discrimination Act of 1975, no order to suspend, terminate, or refuse to grant financial assistance can take effect until (a) the NEA Chairman has advised the recipient or applicant of its failure to comply with the Age Discrimination Act and that voluntary compliance can be obtained; and (b) 30 days have elapsed after the Secretary files a "written report" of the circumstances and ground for the action with "the committees of Congress having legislative jurisdiction" over the program or activity at issue.
