Civil Penalty Proceedings in Regional Offices
This scheme provides for the a hearing before a Regional Judicial Officer with an appeal available to the Environmental Appeals Board for certain civil penalty cases.

The Administrator also has the option of exercising the authority of a Hearing Officer the hearing level, negating the necessity for an appeal to the agency head as required under the APA. See 40 CFR 108.7.
