Air Monitoring and Fuel Economy
This adjudication scheme provides for an oral hearing before a presiding officer in some cases to determine whether an applicant for a reference or equivalent method determination for ambient air quality standards had his or her method properly rejected or whether a manufacturer's fuel economy data is sufficient.
For cases involving the review of the denial or revocation of a certificate of conformity for nonroad compression-ignition engines the Hearing Officer is a designee of the Administrator.
The applicant can then appeal this decision to the Administrator of the EPA or his authorized representative.
