Scheme Nickname:
DEA Informal Enforcement Proceedings

Informal proceedings in which the DEA enforces provisions of the Controlled Substances Act or the Controlled Substances Import and Export Act. A Special Agent in Charge of the DEA may grant a private and informal hearing to any individual who is facing criminal or civil action under either Act to give an opportunity for the individual to present his or her views and proposals to bring his or her alleged violations into compliance with the law. Hearings may also permit the individual to show cause why prosecution should not be instituted or to present his or her views on the contemplated proceeding. 21 CFR 1316.31.

Comments/Notes on Adjudication Structure:
The hearing officers in this scheme are Special Agents in Charge, who run various regional or specialized divisions and offices in the DEA. The Office of the Deputy Administrator is listed as the hearing office because based on the DEA organizational chart, that office appears to be the most likely to oversee the regional and specialized divisions and offices.
